Hold Harmless Waiver

Below is the Hold Harmless Waiver for our LUMA Ice Rink

When purchasing tickets, you must agree to the below waiver prior to finalizing your purchase

In consideration for being permitted by the city of Petaluma to participate in the above-referenced activity, I hereby waive, release, and discharge any and all claims for damages for personal injury, death, or property damage which I may have, or which may hereafter accrue to me, as a result of participation in said activity. This release is intended to discharge in advance city of Petaluma (including its officers, employees, volunteers, contractors, and agents) and any community organization co-sponsoring the program, from any and all liability arising out of or connected in any way with my participation in said activity, even though that liability may arise out of active or passive negligence or carelessness on the part of the persons or entities mentioned above.

It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs, administrators, executors, and assigns and that I shall indemnify and hold city of Petaluma (including its officers, employees, volunteers, contractors, and agents) and any community organization co-sponsoring the program free and harmless from any loss, liability, damage, cost, or expense which may arise out of or connected in any way with my participation in said activity.

Additionally, I fully understand that my participation in the above-referenced activity exposes me to the risk of personal injury, death, and/or property damage. I hereby acknowledge that I am voluntarily participating in this activity and agree to assume any such risks.

PHOTOGRAPHIC RELEASE: I understand that photographs may be taken during this activity and hereby grant city of Petaluma permission to use any such photo(s) for advertising or in promotional materials.

I hereby consent that my son/daughter participate in the above-referenced activity, and I hereby execute the above Agreement, Waiver, and Release on his/her behalf. I state that said minor is physically able to participate in said activity. I hereby agree to indemnify and hold city of Petaluma (including its officers, employees, volunteers, contractors, and agents) and any community organization co-sponsoring the program free and harmless from any loss, liability, damage, cost, or expense which may arise out of or connected in any way with said minor’s participation in said activity.

I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND CITY OF PETALUMA AND I SIGN IT OF MY FREE WILL.

A cambio de que la ciudad de Petaluma me permita participar en la actividad mencionada anteriormente, por la presente renuncio, eximo y libero de toda responsabilidad por cualquier reclamación por daños y perjuicios por lesiones personales, muerte o daños a la propiedad que pueda tener o que pueda acumular en el futuro como resultado de mi participación en dicha actividad. Esta exención tiene por objeto eximir por adelantado a la ciudad de Petaluma (incluidos sus funcionarios, empleados, voluntarios, contratistas y agentes) y a cualquier organización comunitaria que copatrocine el programa, de toda responsabilidad derivada o relacionada de cualquier manera con mi participación en dicha actividad, incluso si dicha responsabilidad se deriva de una negligencia o descuido activo o pasivo por parte de las personas o entidades mencionadas anteriormente.

Se acuerda además que esta renuncia, exención y asunción de riesgos será vinculante para mis herederos, administradores, albaceas y cesionarios, y que indemnizaré y eximiré a la ciudad de Petaluma (incluidos sus funcionarios, empleados, voluntarios, contratistas y agentes) y a cualquier organización comunitaria que copatrocine el programa de cualquier pérdida, responsabilidad, daño, costo o gasto que pueda surgir o estar relacionado de alguna manera con mi participación en dicha actividad.

Además, entiendo perfectamente que mi participación en la actividad mencionada anteriormente me expone al riesgo de lesiones personales, muerte y/o daños materiales. Por la presente, reconozco que participo voluntariamente en esta actividad y acepto asumir dichos riesgos.

AUTORIZACIÓN FOTOGRÁFICA: Entiendo que se pueden tomar fotografías durante esta actividad y por la presente otorgo a la ciudad de Petaluma permiso para utilizar dichas fotografías con fines publicitarios o en materiales promocionales.

Por la presente, doy mi consentimiento para que mi hijo/hija, participe en la actividad mencionada anteriormente, y por la presente ejecuto el Acuerdo, Renuncia y Liberación anteriores en su nombre. Declaro que dicho menor es físicamente capaz de participar en dicha actividad. Por la presente, acepto indemnizar y eximir de responsabilidad a la ciudad de Petaluma (incluidos sus funcionarios, empleados, voluntarios, contratistas y agentes) y a cualquier organización comunitaria que copatrocine el programa por cualquier pérdida, responsabilidad, daño, costo o gasto que pueda surgir o estar relacionado de alguna manera con la participación de dicho menor en dicha actividad.

HE LEÍDO ATENTAMENTE ESTE ACUERDO, RENUNCIA Y EXONERACIÓN Y ENTIENDO PLENAMENTE SU CONTENIDO. SOY CONSCIENTE DE QUE SE TRATA DE UNA EXONERACIÓN DE RESPONSABILIDAD Y UN CONTRATO ENTRE MÍ Y LA CIUDAD DE PETALUMA, Y LO FIRMO POR MI PROPIA VOLUNTAD.
